Until 30 September 1998 a child over the age of 10 and under the age of 14 was similarly below the age of criminal responsibility unless the prosecution could prove that he knew that his actions were "seriously wrong" rather than "mere naughtiness": IPH v Chief Constable of South Wales [1987] Crim LR 42. However, section 34 of the Crime and Disorder Act 1998 (effective from 30 September 1998) abolishes the rebuttable presumption that a child over the age of 10 but under 14 is doli incapax and such children will, for the purposes of the criminal law, be treated as other juveniles when deciding whether or not it is appropriate to prosecute
